Vehicle Code section 16056 sets the floor for proof of financial responsibility, and that floor moved. For policies issued or renewed on or after January 1, 2025, the minimums are $30,000 for bodily injury or death of one person, $60,000 for two or more people in one accident, and $15,000 for property damage. Older policies still carry the previous $15,000, $30,000 and $5,000 limits. Either way, an intensive care admission can exhaust the entire bodily injury limit in a matter of days, which is why every declarations page in the household gets read, along with any employer, resident-relative, umbrella or commercial policy that might apply.

Proposition 213 can delete part of the claim

Civil Code section 3333.4 bars recovery of noneconomic damages in a motor vehicle case in three situations. The injured person owned an uninsured vehicle involved in the crash. Or the operator cannot establish financial responsibility. Or the driver was convicted of driving under the influence in that accident. Economic losses survive. The section carves out one important exception: where the other motorist was convicted of a driving-under-the-influence offense from the same crash, the bar does not apply. Lapsed coverage on a household vehicle is therefore a fact worth confronting immediately rather than discovering during a deposition.

Fault gets fought hardest where the damages are largest

Pure comparative negligence has governed here since 1975, when the state Supreme Court abolished the contributory negligence defense and replaced it with a system assessing liability in proportion to negligence. A percentage reduces the award; it does not extinguish it. Because a ten-point shift moves more money in one catastrophic case than in a hundred minor ones, scene measurements, vehicle event data, signal timing and the earliest recorded statements all draw attention out of proportion to their size. Civil Code section 1431.2 adds the other half of the arithmetic, making noneconomic damages several only and tied to each defendant's own percentage.
